Acceptable Use Policy (AUP)

This Acceptable Use Policy ("AUP") governs your use of ZentPak's AI-powered design tools, including the AI Coffee Bag Designer and related services. This AUP supplements our Terms of Service.

1. Scope and Purpose

ZentPak provides AI-powered packaging design tools to assist businesses in creating professional packaging. These tools must be used responsibly and legally. This policy defines prohibited uses and enforcement mechanisms.

2. AI Models Used

Our AI design tools are powered by:

• Text & Chat: DeepSeek Chat (deepseek-chat) via OpenAI-compatible API
• Image Generation: Stable Diffusion models via Replicate API

Model versions are subject to change for quality improvements. Current models are disclosed at zentpak.com/about#ai-models.

3. Prohibited Content Categories

You must not use ZentPak's AI tools to generate, upload, store, or distribute:

3.1 Sexual and Adult Content (NSFW)

• Pornography or explicit sexual content
• Sexually suggestive or provocative imagery
• Nudity or sexual acts
• Sexual services advertisements

3.2 Violence and Gore

• Graphic violence or physical harm
• Blood, gore, or dismemberment
• Content glorifying violence
• Weapons used in threatening contexts

3.3 Hate Speech and Discrimination

• Content promoting hatred, violence, or discrimination based on:
  • Race or ethnicity
  • National origin
  • Religion or belief system
  • Gender or gender identity
  • Sexual orientation
  • Disability
  • Age or other protected characteristics
• Dehumanizing language or imagery
• Symbols associated with hate groups

3.4 Child Safety (CSAM)

• Any sexual or suggestive content involving minors
• Sexualization of children in any form
• Child abuse or exploitation imagery
• Content that endangers child welfare

Zero tolerance: Immediate account termination and law enforcement report.

3.5 Deepfakes and Identity Misuse

• Fake or manipulated images of real individuals without consent
• Impersonation of public figures, brands, or organizations
• Misleading attribution of statements or actions
• Celebrity likeness without authorization

3.6 Intellectual Property Infringement

• Copyrighted logos, designs, or artwork without permission
• Trademark violations
• Counterfeit product designs
• Third-party brand assets without authorization

Examples of violations:

• Copying Nike swoosh, Apple logo, or Disney characters
• Creating fake "Supreme" or luxury brand packaging
• Using copyrighted artwork from artists without license

3.7 Additional Prohibited Uses

• Fraudulent or deceptive content
• False health claims or unapproved medical product packaging
• Illegal products or services (drugs, weapons, etc.)
• Content violating export control laws
• Malicious code or security threats

4. Content Moderation Mechanisms

4.1 Automated Filtering

• AI outputs are filtered before display using keyword and pattern detection
• Prompts containing prohibited terms are rejected with explanation
• Image analysis detects prohibited visual content

4.2 User Reporting

How to Report Violations:

3. Description of the violation
4. Your contact information (optional for follow-up)

Response Time: We review all reports within 48 business hours.

Confidentiality: Reporter identity is kept confidential unless required by law.

4.3 Platform Monitoring

• Periodic automated audits of generated content
• Manual review triggered by:
  • User reports
  • Suspicious pattern detection
  • High-volume generation from single account
  • Known bad actor IP addresses

4.4 Third-Party Notices

We respond to DMCA takedown notices and intellectual property complaints. See our DMCA Policy for details.

If you believe enforcement action was made in error:

1. Email appeals@zentpak.com within 14 days
2. Include:
   • Account email
   • Violation notice reference number
   • Explanation of why action was incorrect

3. Appeals are reviewed by senior compliance team within 5 business days
4. Decision is final

5.4 Reinstatement

• Suspended accounts may be reinstated after suspension period
• Terminated accounts are not eligible for reinstatement
• Exceptions may be granted for mistaken identity or technical errors

6. Legal Compliance and Cooperation

6.1 Law Enforcement Cooperation

ZentPak fully cooperates with law enforcement agencies. We may disclose user information when:

• Required by court order or subpoena
• Necessary to prevent imminent harm
• Required to investigate illegal activity (especially CSAM)

6.2 Transparency Reporting

We publish annual transparency reports disclosing:

• Number of violations by category
• Enforcement actions taken
• Law enforcement requests received

7. User Responsibilities

By using ZentPak's AI tools, you agree to:

• Use tools for legitimate business purposes
• Respect intellectual property rights
• Report violations you encounter
• Create original or licensed designs

❌ Don't:

• Attempt to bypass content filters
• Generate prohibited content "for testing"
• Use tools to harm others
• Impersonate brands or individuals

8. Safe Harbor and Liability

• User Responsibility: You are solely responsible for content you generate
• No Liability: ZentPak is not liable for user misuse of AI tools
• No Review Obligation: We have no obligation to pre-screen all content
• Right to Remove: We may remove any content at our discretion
• No Damages: We are not liable for enforcement actions taken in good faith

9. Changes to This Policy

We may update this AUP as:

• New AI models are adopted
• New risks emerge
• Legal requirements change
• Best practices evolve

Material changes will be posted 30 days before taking effect. Continued use after changes constitutes acceptance.
